Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility.
OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO) WHO ARE 18 YEARS OF AGE OR OLDER (EXCEPT RESIDENTS OF ALABAMA AND NEBRASKA WHO MUST BE 19 YEARS OF AGE OR OLDER) AT TIME OF ENTRY AND WHO ARE FULL-TIME OR PART-TIME EMPLOYEES AND/OR HIRED AS INDEPENDENT CONTRACTORS OF BEST BUY STORES, L.P., OR BEST BUY ENTERPRISE SERVICES, INC. (I.E., WORKING IN BEST BUY STORES OR BEST BUY CORPORATE, TERRITORY OR DISTRICT OFFICES) IN GOOD STANDING AT TIME OF ENTRY AND PRIZE AWARD. Void in Puerto Rico and where prohibited. All other employees, officers and directors of Best Buy Stores, L.P. (“Sponsor”) and Best Buy Enterprise Services, Inc., and employees, officers and directors of Charch Media Inc. (“Administrator”), and their respective parent entities, subsidiaries and affiliated companies, advertising, promotion, or production agencies, any companies who are promotional participants or prize providers, any companies who are performing work in Best Buy stores at Best Buy’s request, web masters and web suppliers (and their respective IRS dependents, immediate family members [children, spouse, parents, siblings] and individuals residing in their same household, whether or not related) are not eligible to participate. Not open to the general public. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges which are final and binding in all respects. Prizes will only be awarded in conformity with Best Buy’s policy regarding participation in, and accepting prizes in, trade promotions.
2. Description of the Game.
The Best Buy Weekly Football Challenge – Employee Edition (“Game”) is a skill-based activity designed to test your football knowledge by comparing your fantasy team roster to that selected by Brian Dunn (or other Best Buy executive, at Sponsor’s sole discretion). For the 17 weeks corresponding with the 2010 regular season of the league of professional football teams, beginning with the games played on September 8, 2011, and ending with the last game on January 1, 2012, you and our celebrity will each create a fantasy team roster from a list of professional football players set forth at the Game web site at www.bestbuyfantasy.com/employee (“Game Site”). You and the celebrity will receive points based on the actual performance of the players on the field, according to the scoring system set forth in rule 5. The Game will consist of the following elements:
Grand Prize Contest. At the conclusion of the Promotional Period (as defined in rule 3), the participant with the highest point total for a single Week over the entire Promotional Period will win the grand prize set forth in rule 7. (The grand prize winner will NOT be based on the participant’s cumulative total of points over the Promotional Period.) In the event of a tie, the participant with the next highest point total for another Week will be the winner (if a tie still exists after exhausting all weekly entries, the participant who first registered for the Game will be the winner).
Weekly Sweepstakes. At the conclusion of each Week (as defined in rule 3), your roster’s total points will be compared to the total points earned by our celebrity’s roster. For each point you earn that exceeds the celebrity’s point total, you will receive one entry into the sweepstakes drawing for that Week as set forth in rule 6. (Example: The celebrity accrues 100 points in Week one. You accrue 110. You will receive 10 entries into that weekly sweepstakes drawing.) Each weekly sweepstakes will be conducted as a separate promotion and your entries will NOT be carried forward to subsequent weekly sweepstakes drawings.
Promotional Period.
Game begins 2:00:01 p.m. Eastern Time (“ET”) on September 8, 2011, and ends 4:15:00 p.m. ET on January 1, 2012 (“Promotional Period”). A Week begins at 12:00:01 a.m. ET on a Tuesday and ends at 11:59:59 a.m. ET on the next Monday (a “Week”); except for the first Week, which will begin at 2:00:01 p.m. ET on September 8, 2011, and the last Week, which will end at 4:15:00 p.m. ET on January 1, 2012. The Administrator’s computer is the official clock for the Game.
How to Play.
a. Registration. Visit the Game Site at www.bestbuyfantasy.com/employee during the Promotional Period and follow the online registration instructions to create your Game account. There is no charge for creating your account. You will be required to provide your full name, e-mail address, and store number if you are a Best Buy store employee, or insert “CORP” if you are a Best Buy corporate, territory or district employee. You are responsible for ensuring that your name and e-mail address information is current. You may update your name and e-mail address information by accessing the Game Site and following the online instructions. You are responsible for the security of your username and password. You should take precautions to keep your username and password private to prevent unauthorized use. Limit one account per person/email address. Any attempt to register more than once using a different user name and/or password may result in disqualification. Any other form of Internet or e-mail entry/participation is void. You may NOT participate in the Game while performing services and responsibilities in the employ of Best Buy Stores, L.P., Best Buy Enterprise Services, Inc., or their parent entity, affiliates and subsidiaries (i.e., you may not participate during working hours). Neither Sponsor, Administrator nor their respective agencies are responsible for failure to contact participants due to incorrect or inaccurate e-mail addresses or for any losses, damages or consequences that participants may suffer due to careless or unauthorized use of a username and password. If a participant’s employment with Best Buy Stores, L.P., or Best Buy Enterprise Services, Inc., is terminated for any reason at any time up to the time of prize award, the participant’s account will be terminated and all points in such account forfeited.
b. Roster Selection. In addition to registration, you must create your roster by following the online selection instructions. The celebrity’s choices for each Week will be revealed for purposes of comparison. You may participate at any time during the Promotional Period, EXCEPT, with respect to each individual football player, participants cannot access a player for the time period beginning 15 minutes prior to the start of such player’s first professional football game for that Week through the end of that Week (subject to change based on broadcast schedule). (Example: In order to change a player for a game starting at 1:00 p.m. ET, you must successfully submit your change before 12:45 p.m. ET on that player’s first game for that Week.) Instructions for creating and changing your roster of players are provided on the Game Site. There are no penalties associated with changing your roster, and there is no limit to the number of times you may change your roster per Week. No responsibility is assumed for any canceled, rescheduled, unavailable or postponed football games, in whole or in part.
Each Week, you must choose three quarterbacks, four running backs, four wide receivers, two tight ends, two place kickers and one bonus player (a player NOT on your roster). Then you must choose one tagged player who will receive double that player’s points for that Week. If you fail to select a new roster for any given Week as set forth above, you will NOT be eligible to compete for prizes that Week.
5. Scoring. At the end of each Week, Administrator will use the individual football player results from the regularly scheduled professional football games for that Week to award points to the account of each participant who has that player on his/her roster. Weekly points will be awarded in the following manner:
a. Passing. One point for each three passing yards gained (rounded down); 50 points for each touchdown pass thrown; and ten points for each two-point conversion.
b. Rushing. One point for each yard gained; 100 points for each touchdown scored; and 20 points for each two-point conversion.
Receiving. One point for each yard gained; 100 points for each touchdown scored; five points for each reception; and 20 points for each two-point conversion.
Kicking. One point for each yard of a successful field goal. (Example: A 39-yard field goal will generate 39 points.)
Bonus Player. The points earned by the bonus player are determined by how they scored under Passing, Rushing, Receiving and Kicking as set forth above.
Tagged Player. The points earned by your tagged player will be doubled for purposes of your point total.
All points will be based on the official statistics of the organization responsible for governing the league of professional football teams for that Week. Changes made to the official statistics after the conclusion of each Week will not be reflected in the Game. If there is a dispute as to how many points should be awarded, the decisions of the Sponsor are final.
6. Weekly Sweepstakes Prize Drawing.
At the conclusion of each Week, a random drawing to award the weekly sweepstakes prizes will be held from among all eligible sweepstakes entries received for that Week as set forth in rule 2. The odds of winning any prize in any weekly drawing depend on the number of eligible entries received for that drawing. Winners will be notified by phone, email or regular mail, in Sponsor’s sole discretion. Failure to respond to two prize notices within one week following the date of second attempted notification may result in disqualification, in the Sponsor’s sole discretion. In the event of a disqualification, an alternate winner will be selected (for the grand prize trip set forth in rule 7, provided sufficient time remains to verify alternate winner and ticket prize, otherwise grand prize trip will not be awarded).
7. Prizes/Approximate Retail Value (“ARV”) .
a. Grand Prize Contest One (1) Grand Prize The grand prize consists of a business trip for winner to Minneapolis, MN, for lunch with Brian Dunn (or other Best Buy executive, at Sponsor’s sole discretion) in 2011 (exact dates to be determined by Sponsor, in its sole discretion) (there is no value associated with the trip portion of the Grand Prize, because it constitutes and will be treated as a business trip), one (1) Insignia Connected HDTV (Model NS-32E859A11) (ARV $499.99), and one (1) Rocketfish/Rocketboost Wireless Headphones (Model RF-RBWHP01) (ARV $119.99), and one (1) Rocketfish/Rocketboost wireless card for TV (Model RF-RBCARD) (ARV $39.99).
Consolation Prizes are one (1) Insignia Connected HDTV (Model NS-32E859A11) (ARV $499.99), and one (1) Rocketfish/Rocketboost Wireless Headphones (Model RF-RBWHP01) (ARV $119.99), and one (1) Rocketfish/Rocketboost wireless card for TV (Model RF-RBCARD) (ARV $39.99). Total ARV of grand prize: $659.97
Business trip includes round trip coach airfare for winner from a major commercial U.S. airport nearest winner’s residence to Minneapolis, MN; hotel accommodations for one (1) night/two (2) days (one standard room) at a Sponsor-specified hotel; lunch with Brian Dunn (or other Best Buy executive, at Sponsor’s sole discretion); and round-trip ground transportation between airport and hotel. Total ARV of grand prize and consolation prizes: $6,599.70. All travel expenses not stated in these Official Rules and not reimbursable under the Best Buy business travel expense policy are solely the responsibility of the winner, including, without limitation, tips, gratuities, service charges or taxes, meals, ground transportation not specified, hotel room service, beverages, merchandise, souvenirs, local and long-distance telephone calls. Travel and accommodations are subject to change and availability, and restrictions may apply. Winner must be 18 years of age or older (except residents of Alabama and Nebraska who must be 19 years of age or older); must complete, sign and return all affidavits, releases and other documents required by Sponsor prior to ticketing of prize; must have all required documentation prior to departure and is responsible for obtaining such travel documents; must travel on the dates specified by Sponsor, which are subject to change; must present valid government issued photo ID for any events; must take the trip as stated; and must comply with all airport and venue security requirements; or prize will be forfeited in its entirety and may be awarded to an alternate winner, provided sufficient time remains to verify alternate winner and ticket prize, otherwise prize will not be awarded. Sponsor reserves the right in its sole discretion to suspend or cancel the participation of any winner due to noncompliance with any security procedure or inappropriate behavior or misconduct. If trip destination is located less than 200 miles from winner’s residence, Sponsor, in its sole discretion, reserves the right to reimburse winner for driving expenses at a rate of $.50 per mile in lieu of airfare. Travel accommodations are at the discretion of Sponsor. No responsibility is assumed for any cancellation or rescheduling of the trip or any related event or activity, in whole or in part. If any of the foregoing events or activities are delayed, postponed or cancelled for any reason, the travel portions of the grand prize shall constitute full satisfaction of Sponsor’s prize obligation to winner and no substitute or additional compensation will be awarded. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Winner is solely responsible for all applicable taxes, insurance, travel-related expenses not set forth herein and other expenses which may be required for the enjoyment and use of the prize.
b. First Prizes (9). Each First Prize will consist of one (1) 32” Insignia Connected TV Model NS-32E859A11 (ARV $499.99), one (1) Rocketfish/Rocketboost Wireless Stereo Headphones Model RF-RBWHP01 (ARV $119.99), and one (1) Rocketfish/Rocketboost Wireless Card for TV Model RF-RBCARD (ARV $39.99). Total ARV of each First Prize: $659.97. Total ARV of First Prizes for Promotional Period: $5,939.73.

Prizes cannot be transferred, assigned, substituted, or redeemed for cash, but Sponsor reserves the right to substitute any prize with a prize of equal or greater value, should the prize, or any portion thereof, become unavailable for any reason. Prizes will not be fulfilled outside the 50 United States or D.C. Sponsor reserves the right to substitute any prize with a prize of comparable value, in its sole discretion. Winners may not transfer a prize or request any prize substitution. No prizes will be awarded until the winner’s eligibility has been verified.
Taxes on the prize are solely the winner’s responsibility. There are different IRS reporting requirements for employees and contractors. For employees, the IRS considers any prize given to an employee, regardless of value, to be taxable income which must be reported to the IRS; the prize value will be reported on the employee’s paycheck. For contractors, if the cumulative value given to a contractor over the calendar year is $600 or more, the IRS requires that such amount must be reported to the IRS. In order for Sponsor to accurately report the prize value to the IRS, the contractor must provide his/her taxpayer identification number and signature on a Form W-9 and return it to Sponsor before the prize may be awarded. Winners are solely responsible for paying any applicable tax related to the prize. Sponsor may choose, in its sole discretion, to provide assistance with the taxes associated with the prize; such additional funds are also taxable income.
8. General Conditions. Participants certify that they have read and agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. If there is a dispute as to the identity of participant, the authorized account holder of the email address provided at registration will be deemed the participant. The “authorized account holder” is defined as the natural person to whom the email address has been assigned by a service provider with authority to assign such addresses.
Participants agree (a) that Sponsor, Administrator, and their respective parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”), will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Game or any Game related activity; or for any printing, production, typographical, human or other error in the printing, offering or announcement of any prize; and (b) except where legally prohibited, winners grant (and agree to confirm that grant in writing) permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the Internet and/or World Wide Web, without notice, review or approval. Sponsor reserves the right to modify these Official Rules for clarification at any time without materially affecting the terms and conditions of the Game. Potential prize winners must meet the eligibility requirements stated above and must be employees and/or hired as independent contractors as indicated above in good standing as of date of entry and prize award, subject to review by the Sponsor and/or the Best Buy Human Resources Department. If a potential winner is ineligible or deemed not to be an employee or hired independent contractor in good standing by Sponsor and/or the Best Buy Human Resources Department, for any reason, such prize will be forfeited and awarded to an alternate winner (for the grand prize trip set forth in rule 7, provided sufficient time remains to verify alternate winner and ticket prize, otherwise grand prize trip will not be awarded). Potential winners may be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and, where legally permissible, a Publicity Release, within seven (7) days following the date of first attempted notification. If documents are not returned on a timely basis, or if prize is returned as non-deliverable, or if potential winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and awarded to an alternate winner (for the grand prize trip set forth in rule 7, provided sufficient time remains to verify alternate winner and ticket prize, otherwise grand prize trip will not be awarded). By participating in this Game, you acknowledge and agree that Sponsor may collect the personal information submitted by you, and use the information pursuant to Sponsor’s privacy policy available on-line at www.bestbuy.com or by calling 1.888.BEST BUY.
9. Limitations of Liability. Released Parties are not responsible for illegible, lost, late, damaged, destroyed, inaccurate, delayed, incomplete, unintelligible, non-delivered, misdirected, stolen entries; postage due mail; or for incomplete, inaccurate, lost, interrupted or unavailable network, satellite, telephone networks or lines, cellular towers or equipment (including handsets), computer online systems, computer equipment, software, viruses or bugs, servers or providers, or other connections, availability or accessibility; or for unauthorized access to, or alteration of entries; or miscommunications, failed computer, telephone, cellular, satellite, or cable transmissions, lines or other technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, technical, mechanical, electronic or network, including, without limitation, any errors which may occur in connection with the administration of the Game or in any Game-related materials; or for the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the Game or Game Site, as solely determined by the Sponsor, will be disqualified (and all associated entries will be void), and Sponsor reserves the right to terminate such entrant’s eligibility to participate in this or any other promotion offered by Sponsor. Entries generated by robotic, programmed, script, macro or other automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Game or downloading materials from the Game Site. Should any portion of the Game be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend or terminate the Game, and select winners for the corresponding drawing from all non-suspect, eligible entries received for such drawing(s) prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Without limiting the release provided above, and for greater certainty, Released Parties will not be liable for (a) any incomplete or inaccurate information, whether caused by wireless device users or by any equipment or programming associated with or utilized in the Game, or by any technical or human error which may occur in the processing of entries; (b) the theft, destruction or unauthorized access to, or alteration of, entries; (c) any problems with or technical malfunctions of telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses or bugs; (d) any failure of any message to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or wireless waves or at any Web site or combination thereof; or (e) damage to a participant’s or other person’s system or equipment occasioned by participation in this Game. In the event of a dispute as to ownership of a winning entry, the owner of the Reward Zone program member I.D. used to enter, as indicated in Sponsor’s records, will be deemed the winner and must comply with these Official Rules. Caution: Any attempt by an entrant to deliberately damage or undermine the legitimate operation of the Game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.
IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE GAME SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WWW.BESTBUYFANTASY.COM/EMPLOYEE, OR ANY OTHER WEB SITE ASSOCIATED WITH THIS GAME. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. 10. Disputes. Participants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Game or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively in a state or federal court of competent jurisdiction in Minneapolis, Minnesota; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Game, but in no event attorneys’ fees; and (iii) under no circumstances will participants be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expense, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
11. Winners List or Official Rules Request. For a list of prize winners or a copy of theseOfficial Rules, send a self addressed stamped envelope in a separate first class stamped envelope for receipt by January 31, 2012, to: Best Buy Weekly Football Challenge – Employee Edition, Winners List or Official Rules (please specify which), 7601 Penn Avenue South, Richfield, MN 55423, Attention: Michael Tubman (C4-194). The winners’ list will be provided only after all winners have been determined at the conclusion of the Promotional Period. Official Rules will also be accessible at the Game Site during the Promotional Period.
